| The criminal
justice policy (in the US reluctantly followed by the EU) has turned
out in punishing more. This has not much to do with 'crime and punishment'
but rather with a new policy of social insecurity. Its gain is to
mould man and woman in the maelstrom of the economical deregulation
and the transformation of the social help, who now becomes a guide
to an hamburg job. In the framework of this liberal- paternalistic
arrangements the prison receives back his original roll: to crease
a recalcitrant population to accept the ruling economic and morel

Het strafrechterlijk beleid (in

wending genomen.: meer bestraffen. Dat heeft niets van doen met
het tweeluik ‘misdaad en straf’ maar wel met een nieuw
beleid van sociale onzekerheid. Dat wil het gedrag van mannen en
vrouwen kneden in de maalstroom van de economische deregulering
en van de omschakeling van de sociale hulp, die nu een opstap wordt
naar hamburger jobs. In het kader van deze liberaal-paternalistische
schikkingen krijgt de gevangenis haar orrspronkelijke rol terug:
een weerspannige bevolmking doen plooien voor de heersende economische

Le tour résolument punitif pris par les politiques pénales
(aux États-Unis, et de plus en plus en Europe) lors de la
dernière décennie ne relève pas du simple diptyque
" crime et châtiment ". Il annonce l'instauration
d'un nouveau gouvernement de l'insécurité sociale
visant à façonner les conduites des hommes et des
femmes pris dans les turbulences
de la dérégulation économique et de la reconversion
de l'aide sociale en tremplin vers l'emploi précaire. Au
sein de ce dispositif " libéral-paternaliste ",
la police et la prison retrouvent leur rôle d'origine : plier
les populations indociles à l'ordre économique et
